EIN Number for an LLC: How to Get One, What You Need and Common Mistakes
· 3 min read
Every LLC that plans to open a bank account, accept payments or file taxes needs an EIN. The steps are simple once the LLC exists, and a few details decide whether the application goes through the first time. This guide covers the order of steps, what to have ready and the mistakes that cause rejections. For the basics first, read what an EIN number is.
Does an LLC need an EIN?
A multi-member LLC needs one because it files its own partnership return. A single-member LLC owned by a US person may use its owner's SSN for taxes, but banks and payment providers still ask for an EIN, so most owners get one. A single-member LLC owned from outside the US needs an EIN for its yearly IRS reporting. See which tax form your LLC files.
Step by step
- Wait for the state to approve the LLC. You need the approved name and the formation date.
- Collect the details. The LLC's exact legal name, the address on the state record, the state and date of formation, and the owner's name and tax ID, if any.
- Choose the route. With an SSN or ITIN, the IRS online application is usually quickest. Without one, apply with Form SS-4 by fax or mail. See how to get an EIN without an SSN.
- Answer the form carefully. It asks the entity type (LLC), the number of members and the reason for applying.
- Save the confirmation. The IRS sends a letter with the number. Keep a PDF copy.
How long it takes
The online route returns the number the same session for those who qualify. Fax and mail take longer. Compare it with the other stages in how long it takes to register an LLC in the USA.
Mistakes that cause rejections
- Name mismatch. The name must match the state record exactly, including "LLC".
- Applying too early. The IRS needs the company to exist.
- Wrong responsible party. It must be the real person who controls the LLC.
- Vague business description. Say what the LLC does.
After you have the EIN
- Open a bank account in the LLC's name: US business bank account for non-residents.
- Write the operating agreement.
- Put the yearly filing in your calendar: Form 5472.
